Town of Old Saybrook

NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Regular Meeting that was held on Wednesday, October 9, 2013  at 7:30 p.m. at  the Town Hall, First  Floor Conference Room, 302 Main Street, heard and decided the following appeals:

Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Robert McIntyre, Christopher Billiau, alternate
and Alan Spargo, alternate

Present:  Kim Barrows, Clerk

Absent:  Adam Stillman, Secretary, Philip Broadhurst and Carl Garbe, alternate

The meeting was then called to order at 7:30 p.m.

The following public hearings were conducted, as well as the decision making sessions.  The meeting has been recorded on tape and the following actions were taken:

The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.

13/14-15C Bernard & Carole Kowalski, seek a variance of Par. 10.8.1 & 10.8.2 (nonconformity enlargement/change); Par.24.5.1 as modified by 68.1.2.B4 (narrow street line setback/36.15’ required/20.2’ proposed); Par 24.5.3 (other property line setback/15’ required/8.1’ proposed on north side and 11.1’ proposed on south side); and Par. 24.6.2 (maximum building/ structure coverage/20% allowed/27.1% proposed) of the Zoning Regulations to permit an addition and covered entry way on property located at 41 Sea Lane-2, Map 19/Lot 250

Discussion with respect to the public hearing that closed this evening.  There is a slight reduction in the coverage with the removal of decking and reconfiguration of space.  Work being done to an existing structure and estimates of work will be below 50% of the appraised value of the structure so that the applicant does not have to meet FEMA regulations.  The flood elevation is 11’, the finished first floor is elevation 11.13’.  

A Motion was made by R. McIntyre, seconded by A. Spargo to GRANT Application 13/14-15C – Bernard & Carole Kowalski, per the plans submitted.  The hardship is the size of the lot and the narrow street setback. The Coastal Site Plan Review Application is approved as well because it is consistent with all applicable coastal policies and includes all reasonable measures to mitigate adverse impacts.  The DEEP offered no comments at this time.  No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, R. McIntyre, C. Billiau, A. Spargo   Opposed: None  Abstaining: None  The motion passed unanimously. 5-0-0

13/14-09 Lou Ann Naples, seeks a variance of Par 10.7.1 & 10.7.2 (nonconformity enlargement/ change); Par. 24.5.1 as modified by 68.1.2.B4 (narrow street line setback/30’ required/19.9’ proposed) and Par 24.5.3 (other property line setback/15’ required/5.8’ proposed on west side and 4’ proposed on east side) of the Zoning Regulations to permit a dormer addition on property located at 21 Sea Crest Road, Map 004/Lot 237.

Discussion with respect to the public hearing that closed this evening.  The addition is on expanding the footprint.  The dormers are for extra light and additional space.  The existing shed will be moved to a conforming location as a condition of approval.

A Motion was made by R. McIntyre, seconded by A. Spargo to GRANT w/condition Application 13/14-09 – Lou Ann Naples. The application is granted as submitted with the condition that the shed be moved 5’ from the rear and 5’ from the sideline setback.  The condition of moving the shed will be in lieu of a sufficient hardship since one had not been shown.  No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, R. McIntyre, C. Billiau, A. Spargo   Opposed: None  Abstaining: None  The motion passed unanimously. 5-0-0

REGULAR MEETING:

Minutes of the September 11, 2013 continued to September 18, 2013 Regular Meeting and Minutes of the September 25, 2013 Special Meeting:

A Motion was made by R. McCall, seconded by R. McIntyre to approve the Minutes of the September 11, 2013 continued to September 18, 2013 Regular Meeting and the Minutes of the September 25, 2013 Special Meeting as presented.  No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, R. McIntyre, C. Billiau, A. Spargo   Opposed:  None  Abstaining: None   The motion passed. 5-0-0  

2014 Meeting Schedule:

A Motion was made by R. McCall, seconded by R. McIntyre, to APPROVE the 2014 Meeting Schedule.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, R. McIntyre, C. Billiau, A. Spargo Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  

Regional Plan of Conservation and Development:

The Board discussed the Regional Plan of Conservation and Development: Regional Visions, Concerns and Questions.  The consensus of the Board is to defer to the visions which the Zoning Commission and the Planning Commission put forth for the Town of Old Saybrook.

Adjournment:  A Motion was made by R. McCall, seconded by R. McIntyre to adjourn the October 9, 2013 Regular Meeting of the Zoning Board of Appeals.   No discussion and a vote was taken: In favor: R. McCall, D. Alexander, R. McIntyre, C. Billiau, A. Spargo Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  The meeting was adjourned at  8:25 p.m.
